• These terms of use apply to business relations between dr-kappa services ltd (from now on: dr-kappa® ) and their customers achieved by using common offers from our websites or those requiring registration on our specialized portals joint to our vertical portal www.dr-kappa.com for Chemical Industry, Chemical Trade and Chemical Transportation Branch.
• In all descriptions, content and offers on our websites, it is exclusively the German version which is legally binding.
• Contents of our websites are addressed to competent experts in enterprises of the sectors Chemical Industry and Chemicals Transportation Branch.
• Databases of our websites contain among other things compilations and reproductions from different lists of chemical substances with varying nomenclature from public sources, especially laws and regulations.
  dr-kappa® simply extracted and reproduced data from these sources. drkappa® neither validated correctness, completeness, and up-to-dateness of substance lists in respective languages nor corrected or harmonized different descriptions.
  Usage of these substance lists extracted from official sources (laws, regulations) is provided for free. They are shown modified according to the relevance for the different business objectives of our websites.
  Our substance databases provided contain neither technical function for selection of correct and relevant substances nor analysis of substance identity for the different target users.
  Selection of data made available, as well as their control concerning actuality, correctness and relevance is the customer's own responsibility. Our offers do not include customization in any form.
• Automatted or systematic copying of our data bases and the contents therein is disallowed. We reserve the right to block the account and/or corresponding internet address and take legal measures.
• By registration you are secured by SSL-certificate on our website.
  Our invoices you obtain by eMail including qualified electronic signature. These invoices with qualified electronic signature you may submit electronically to your local tax authorities for refund of turnover tax or incorporating operationg expenses.
  By registration (enterprise and address; phone, fax, and eMail of contact person; password) and confirmation of present terms of use, the customer obtains access confirmation (eMail confirmation) whose acceptance (answer by eMail confirmation) enables access to current services.
  The access code is for the exclusive use of the customer and may not be passed on. Rights of access are not assignable to other enterprises.
  The user can have early termination of the offers of each of our websites or all of them at any time, following written notification to dr-kappa®. Ordinary termination period by dr-kappa® is two weeks. By full finalization of use all customer's entries will be deleted from our website(s).
  If a user is misusing our website(s) we have the right to terminate his account without notice.
• dr-kappa® is authorized to change content and/or scope of offers as long as scope of contract is not or is only negligibly affected. dr-kappa®’s updates are oriented towards changes on actual legal developments, common commercial relevance, changes in users behavior, and adaptations regarding the state-of-art.

• But, hints to laws and regulations to chemical substances are for raw orientation of customers, only. They do not discharge users from investigating in own responsibility concerning actuality, completeness, applicability, and correctness.
• The permanent availability of our website(s) is not critical for customers business. Nevertheless, dr-kappa® will keep the websites available during usual opening and working hours. Planned maintenance work which might affect usability dr-kappa® will try to do outside regular business hours.
• Liability for gross negligence of lower level performing agent as well as slight negligence is excluded in total provided that this does not affect the obligation towards duties of high importance in contractual conditions (cardinal duties).
• Place of jurisdiction is Mainz, Germany.

Data protection hints

• We gather and use personal data keeping data protection requirements exclusively as required for the purpose of usage relations with customer.
• We record your agreement for data assessment and storage. On registration the customer obtains confirmation via e-mail. Customers obtains right of access after mentioned e-mail has been confirmed by the customer. Because we collect data which are required for the respective offer, customer may not use the offer without prior agreement.
• Personal data, e.g. including IP address, may be affected in particular when entering data for newsletter subscription (especially e-mail address), participation in electronic payment procedures as well as login into our services for REACH and chem4biz.
• We inform you our websites use the tool "Google Analytics" from Google Inc. By usage of our websites you agree to data processing by Google as follows:
  "Google Analytics" uses "Cookies" for customer analysis of our websites without the goal to indentify single person. Be aware the information generated by Cookies including your IP address are processed and stored on servers within the United States of America. Google Analytics combines the Cookie information in report transferred to us concerning usage of our websites.
  If you deny "Cookies" by your browser full functionality of our websites is not ensured.

• "dr-kappa®" is an internationally registered trade mark.
• The usage of our offers does not constitute any rights by the user in connection with the contents of our websites. The contents of the websites must not be copied unless it is part of the contract between dr-kappa® and the customer of the respective offer.
